Beacon's Reach Marina Rules 2005

General
- Slips shall be leased on an annual basis only to bona fide owners in good standing of Beacon's Reach Master Association, Inc. (BRMA). In order to lease a slip an owner must be at least an equal partner in the Beacon's Reach unit.
- In order to have an assigned slip or to utilize the boat storage area, an owner must have a boat registered in their name and not have outstanding balances due beyond 90 days. Outstanding balances will be handled in accordance with BRMA rules.
- Slips shall be leased for one calendar year commencing January 1 with assessments payable in advance. Owners who sell their unit during the year will lose their slip lease. (Refunds of annual fee will not be done).
- Slips and storage spaces will be leased on a priority basis where present lessees will have priority of renewal in future years over new applicants. Renewal notices will generally be mailed to lessees on or before January 15 of the year of renewal.
- There will be maintained a priority list for boat slips and a separate priority list for storage spaces, if needed. New applicants are assigned a priority number based on the date of their application for the slip or space.
- The slip assignment period will be the first quarter of each calendar year. Once a slip or storage space becomes available the owner next on the priority list has first option on the slip. If said owner declines his option for two (2) consecutive assignment periods he will go to the end of the list.
- Each condominium or single family unit is permitted to lease only one boat slip and or one boat storage space unless there are vacant slips available. Owners of multiple units are permitted to lease only one boat slip unless there are vacant slips available.
- Lessees are not permitted to sublet or lend their slips to others; subletting shall be by the Dock Master only. NO EXCEPTIONS.
- Priority in subletting will be given to Beacon's Reach owners as opposed to renters. Property owners will be sublet to on a "first come", "first serve" basis.
- A numbered decal system will be used for all boats in marina and, all boats, trailers, jet skis, wind surfers, etc. in boat storage. NO DECAL - NO ACCESS.
- All boats utilizing marina, as well as all boat trailers, Jet Ski, sailboats in boat storage shall have a current decal.
- Any person using the BOAT RAMP, including short-term renters will be required to have a decal.
- BRMA will maintain all slips, mooring facilities, and ramps. However, any damage caused directly by an individual shall be the responsibility of the individual involved.
- There will be assigned spaces in the boat storage yards (future plan). No personal signs will be permitted.
- Renters, if space is available, will be allowed to store their boat or trailer at the marina storage yard.
- Any individual who leases a slip will be required to have liability insurance on their vessel.
- There shall be no "living aboard" overnight on any boat within the marina in accordance with Chapter 16 of the ordinance of the Town of Pine Knoll Shores.
- A closed head system shall prevail for all boats in the Association Marina in accordance with Chapter 16 of the ordinance of the Town of Pine Knoll Shores.
- Racing of engines and boisterous activity is prohibited.
- Sailboat halyards should be secured so they do not slap the mast.
- Boats shall be moored within the Marina only in designated boat slips. No docking shall be allowed along the bulkhead and docks. Day docking shall be allowed in designated areas along the western bulkhead and docks.
- All dock boxes will conform to a standard established by the Board. Dock boxes shall be installed by the Association at the owner’s expense. Upon permanent termination of slip lease the lessee is responsible to remove the Dock Box, or as an alternate, donate it to the Marina. If the Marina Committee asks a slip lessee to move to another slip and a dock box is involved, the Marina will pay to move the dock box. If the slip holder requests a move, they slip holder will pay for the box to be moved.
- Boats discharging oil, gasoline or other noxious substances shall be removed from the Marina upon request of the Beacon's Reach General Manager or the Dock Master.
- All persons utilizing the marina facilities will keep all docks, piers, walkways, and boat ramp clear of all personal gear. This shall include but is not limited to gas tanks, life preservers, fishing equipment, sailboards, and jet skis.
- Names on slips will not be permitted. Slips will have numbers only. A list of slip assignments will be placed at the end of each dock, at the Dock Masters office, and at the BRMA office.
- Maximum length of boat allowed in the marina will be thirty-six feet, total length.
- When a slip holder is not using his assigned slip on weekends & holidays, the Dock Master will be notified so that the slip can be subleased. All income from the subleasing will be placed in a pool. At the end of the year, fifty percent of the pool after expenses will be divided between the slip holders who offered their slips for sublease on weekends & holidays on a prorated basis of how much time they allowed their slip to be subleased.
- All slip holders will be required to fill out a calendar for the period of April 1, 2005 to July 15, 2005 and return it with their slip renewal. Another calendar will be filled out and submitted by June 2, 2005 to cover the period from July 15, 2005 to September 30, 2005. If no calendar is submitted, the slip will be subleased. If changes to your calendar are made, notify the Dock Master if the slip is not used by the lessee, the lessee will be billed for non-usage during the Holiday weekends. This is very important for refunds at the end of the season.
- Spaces on the north wall will not be leased for periods of longer than one week. Priority will be given to non-slip holders who have their boats in the marina on a full time basis.
- The Marina Committee with the agreement of the Dock Master reserves the right to rescind a slip holder’s privileges as a result of continuing violations of the marina rules or for failure to cooperate with the Dock Master.
- Dock Master or appropriate BRMA personnel will have the authority to board any boat in the Marina to take appropriate action to include moving the boat to prevent damage, or further damage, to persons, boats, or structures within the Marina or to insure marina maximum use. Dock Master or appropriate personnel will have the authority to move any boat that is in an unauthorized slip or whose lease period has ended.
- Boats stored in the boat storage area that require a State Registration must have a current registration.
- If a lessee sells their boat, they have one (1) calendar year from the date of sale to purchase another or they will relinquish their slip.
Dock Master
- The marina facility and boat storage area shall be overseen by the Dock Master, approved by the BRMA Board of Directors or the General Manager.
- Dock Master will have established hours during the season (Mid-April through September) and be on site Friday, Saturday, Sunday and Monday.
- Dock Master will have a separate phone line, with answering machine.
- The marina committee along with the Dock Master has the right to assign slip locations based on the size of boats and availability of slips
Rates
- For the 2005 season there will be one rate for all permanent slip assignments and all full time leases.
The rate will be $500 for the year plus applicable electric fees. Boats having the capability of using
shore power will be charged an annual fee of $75.00. Boats utilizing air conditioning and heat pumps
while docked in the slip will be charged an additional $200.00. RV’s in the storage yard using electricity
will be charged $200.00 per year.
- The rate schedule for weekend and weekly subleasing for both property owners and non-property owners will be:
Daily:$25.00; Maximum: $500.00
